ACUM fees for using works from the ACUM repertoire on the Internet – June 2009

Following is a model for calculating royalties for use of works from the ACUM repertoire on the Internet.

Please note that this model does not constitute a license, and you must arrange a license in advance and in writing with ACUM before making any use of works on the Internet.

Fee for listening / viewing works via streaming format on the Internet

1. 1.       License fee for a service offering musical works (song / music clip / live musical performance):

12.5% of the income from the service, but no less than the agreed minimum:

0.4 agora – for each playing / viewing of the work via the musical service

1. 2.       License fee for a service offering content that incorporates musical or literary works (film / series / program, etc.):

3.125% of the income from the service, but no less than the agreed minimum:

0.025 agora – for viewing each minute of content (production) in which works are incorporated

0.4 agora – for each playing / viewing of a musical work

1. 3.       License fee for a user content website:

3.125% of the income from the website, but no less than the agreed minimum:

0.025 agora – for viewing each minute of content (production) in which works / parts of works are incorporated

To calculate the minimal sum for use of works, in the context of user content, a sample of the 100 most viewed files can be used, according to the following alternative model:

A – Total songs, video clips and live performances

B – Total productions (contents) in which a work / part of a work is incorporated

{0.4 * A/100 agora 0.0375 * B/100 + agora } * Total views of all the audio-video files in the service

(*) Calculated according to the average user content (production) time – 1.5 minutes

License fee for music listening packages for which the consumer pays a monthly subscription fee

License fee

12.50% of the income, but no less than the following minimum:

Minimal sum:

1. 1.50 NIS per subscriber per month for one platform (Internet only)
2. 2.15 NIS per subscriber per month for two platforms (Internet and cellular)

Download fee for works on the Internet

License fee and minimal sum:

12.5% of the income from the service, but no less than 30 agora per download

Fee for viewing texts and music notes

License fee

For a service enabling viewing of works - 12.50% of the income for the service, but no less than the following minimum:

Minimal sum:

For viewing a work that contains text and notes – 4 NIS for every 1,000 views

For viewing a work that contains text only – 2.66 NIS for every 1,000 views

For viewing a work that contains notes only – 2.66 NIS for every 1,000 views

For viewing a work that contains chords only – 1.33 NIS for every 1,000 views

Fixed monthly fee for a website with small scope of activity that is not commercial

The fees apply to a website whose combined monthly visits are no greater than 50,000, as specified following:

*  The fees are set at ACUM’s discretion and sole responsibility.

*  The minimum fees are valid for 1.6.2009, and will bear linkage differentials according to the rate of increase of the consumer price index
